قبول الشروط

أنت توافق على هذه الشروط عند إنشاء حساب، أو الوصول إلى منصتنا، أو استخدام أي من خدمات Zimam. إذا كنت لا توافق، فلا تستخدم Zimam. يجوز لنا رفض تقديم الخدمة لأي شخص وفقًا لتقديرنا الخاص.

Zimam هو محرك قرار للتجار. يُمنح حق الوصول فقط لأغراض تجارية مشروعة تتعلق بإدارة عمليات التاجر، وبيانات العملاء، ومبادرات نمو الإيرادات. لا يجوز استخدام Zimam في أنشطة غير قانونية، أو جمع معلومات استخباراتية تنافسية، أو لأي غرض يخالف القانون المعمول به.

استخدامك لـ Zimam شخصي بك وبمؤسستك. لا يجوز نقل بيانات اعتماد حسابك أو بيعها أو مشاركتها مع أطراف ثالثة دون موافقة كتابية من Zimam.

استخدام المنصة

أنت مسؤول عن الحفاظ على سرية بيانات تسجيل الدخول ومعلومات حسابك. لا يتحمل Zimam أي مسؤولية عن الوصول غير المصرح به الناتج عن إخفاقك في حماية كلمة المرور أو تفاصيل حسابك.

توافق على عدم إجراء الهندسة العكسية أو فك التجميع أو محاولة اكتشاف الشيفرة المصدرية أو التقنية الأساسية لـ Zimam. لا يجوز لك استخراج البيانات (Scraping)، أو استخدام أدوات آلية، أو الوصول إلى المنصة بطرق تعطّل الخدمة عن المستخدمين الآخرين.

يقدّم Zimam المنصة كما هي (as-is). لا نضمن استمرارية الخدمة دون انقطاع، أو خلوّها من الأخطاء، أو أن جميع الميزات ستلبي احتياجات عملك الخاصة. قد تحدث انقطاعات في الخدمة لأغراض الصيانة أو التحديثات أو الأمان، بإشعار مسبق أو دونه.

Intellectual property

All content, software, designs, and materials on Zimam are owned by Zimam or our licensors. This includes the merchant dashboard interface, AI recommendation engine, loyalty platform, and all associated documentation. You retain ownership of your merchant data and customer information.

You grant Zimam a license to use your data solely to provide services, improve our platform, and generate insights specific to your business. We do not sell your merchant data to third parties. Your data is processed according to our Privacy Policy.

You may not copy, modify, distribute, or create derivative works from Zimam's platform, code, or content without explicit written permission. Unauthorized use of our intellectual property will result in immediate account termination and legal action.

User responsibilities

You are solely responsible for the accuracy and legality of all data you input into Zimam. This includes customer information, transaction records, loyalty program terms, and promotional content. You warrant that you have obtained all necessary consents from customers before uploading their data.

You agree to comply with all applicable laws regarding data privacy, consumer protection, and fair business practices. You are responsible for ensuring your use of Zimam's AI insights and recommendations complies with local regulations, including those governing automated decision-making and customer communications.

You may not use Zimam to engage in discriminatory practices, fraud, or deceptive marketing. You are responsible for the content of any campaigns, offers, or communications generated through our platform.

Payment and billing

Payment terms are specified in your service agreement or invoice. Fees are billed according to your selected plan and usage metrics. You agree to pay all invoices in full by the due date.

If payment fails, Zimam may suspend your account after providing notice. Continued non-payment may result in permanent termination and referral to collections. You are responsible for all costs associated with collection efforts.

Zimam reserves the right to modify pricing with thirty days' notice. Price changes apply to renewals of your subscription. Early termination fees may apply if you cancel before your contract term ends.

Service availability

Zimam maintains industry-standard security and infrastructure to ensure platform availability. However, we do not guarantee 99.9% uptime or any specific service level agreement unless explicitly stated in your contract.

Scheduled maintenance windows may occur during off-peak hours. Emergency maintenance may be performed without notice if required for security or system stability. We will notify you of extended outages through our status page and email.

Your access may be suspended if you violate these terms, fail to pay invoices, or pose a security risk to our platform or other users. We will provide notice of suspension when possible.

Limitation of liability

Zimam is provided as-is without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or suitable for your specific business needs.

To the maximum extent permitted by law, Zimam is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform. This includes lost revenue, lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of Zimam shall not exceed the fees you paid in the twelve months preceding the claim.

Termination

Either party may terminate the service agreement with written notice as specified in your contract. Upon termination, your access to Zimam will be revoked immediately.

Zimam may terminate your account without notice if you violate these terms, engage in illegal activity, or pose a security threat. You will lose access to all platform features and data upon termination.

Upon termination, you may request export of your merchant data in a standard format within thirty days. After thirty days, we may delete your data in accordance with our data retention policy.

Governing law and dispute resolution

These terms are governed by the laws of the jurisdiction specified in your service agreement, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in that location.

Before pursuing legal action, you agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration or litigation as specified in your agreement.
